By accessing or using the services provided by Mahalo Studios ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Mahalo Studios provides web development, custom software, digital marketing, and SEO services. The scope, timeline, and deliverables for each project are defined in individual project agreements or statements of work signed by both parties.
Payment terms are outlined in your project agreement. Invoices are due within 14 days of receipt unless otherwise specified. Late payments may result in a pause of services. All fees are non-refundable unless explicitly stated in your project agreement.
Upon receipt of full payment, all custom work created specifically for your project becomes your property. Mahalo Studios retains the right to showcase completed work in our portfolio and marketing materials unless a non-disclosure agreement is in place.
Both parties agree to keep confidential any proprietary information shared during the course of the engagement. This includes business strategies, technical specifications, and any other information marked as confidential.
Mahalo Studios shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the total fees paid by you in the three months preceding the claim.
Either party may terminate a project engagement with 30 days written notice. You will be billed for all work completed up to the termination date. Mahalo Studios reserves the right to terminate immediately in cases of non-payment or breach of these terms.
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised terms.
